Investor Protection Programme
The Investor Protection Programme may pay compensation to an eligible complainant when a member firm fails to comply with a final GFCRS decision within 90 days of the decision date. The programme pays the unpaid amount of the award, up to €100,000 per complainant, across all claims against the same member firm. Payment by the programme does not release the member firm from its obligation. GFCRS may seek to recover any amount paid from the member firm. The programme is discretionary and operates only within the funds available to it.
A complainant may claim under the programme only if all of the following apply: - The complaint was filed through the GFCRS complaint process against a firm that was an active GFCRS member when the disputed events took place. - GFCRS issued a final decision in favour of the complainant. - The member firm did not pay the awarded amount within 90 days of the decision. - The complainant is an individual retail client, not a professional client or a company. - The claim is made within 6 months of the payment deadline.
The programme does not cover: - Trading losses resulting from market movements. - Amounts not awarded in a final GFCRS decision. - Claims against firms that were not active members at the time of the disputed events. - Claims involving fraud, market abuse or false information by the complainant. - Interest, legal fees and indirect or consequential losses. - Amounts already recovered from the member firm or from another scheme.
The programme is funded by 10% of the membership fees paid by member firms. These funds are held in a separate bank account, kept apart from GFCRS operating money, and used only to pay claims under the programme.
1. After the payment deadline passes, contact us at [email protected] and quote your GFCRS case reference. 2. Send proof that the member firm has not paid the award, such as account statements or correspondence. 3. GFCRS confirms your eligibility within 14 days and may ask for more information. 4. If your claim is approved, we pay it by bank transfer within 90 days of approval. 5. If your claim is rejected, we explain why in writing. You may ask for a review within 90 days.
Nature of the programme
The programme is a private, contractual arrangement operated under the terms above. It applies only to the claims, limits and conditions described on this page, and does not replace any protection provided by law or by a firm’s own arrangements.
